1. Who we are
These Terms of Service ("Terms") govern your use of the SCJ Hogar website and the web-based applications we offer (together, the "Services"). The Services are operated by SCJ Hogar LLC ("SCJ Hogar", "we", "us"), a limited liability company organized under the laws of Wyoming, United States, with its principal office at 8200 NW 41st Street, 2nd Floor, Doral, FL 33166, United States. By using the Services or buying access to an app, you agree to these Terms.
2. Eligibility
You must be at least 18 years old and able to enter into a binding contract to use the Services. If you buy access for a family member, you remain responsible for that use under these Terms.
3. Your account and access credentials
Access credentials are personal to you. Keep them confidential and do not share them. You are responsible for activity under your access. Tell us right away if you believe someone else is using it.
4. Purchases and access
Each app's page states what is included, the access period and the price in the currency shown. Payment is due at the time of purchase and is processed by a third-party payment processor. We do not receive or store full card numbers.
Unless an app's page says otherwise, a purchase is a one-time payment for the stated access period and does not renew automatically. Where a subscription is offered, that is stated clearly before you pay, and you can cancel at any time as described in our Refund & Cancellation Policy.
Access is delivered digitally after payment is confirmed. Applicable taxes may be added at checkout where the law requires.
5. Refunds and cancellations
Refunds and cancellations are governed by our Refund & Cancellation Policy, which forms part of these Terms.
6. Wellness content, not medical advice
The Services provide general educational and wellness content to support everyday self-care. They are not medical devices. They do not diagnose, treat, cure or prevent any disease or condition, and they do not replace advice from a doctor or other licensed professional. Talk to a qualified professional before changing your diet, exercise, sleep or medication. If you think you are having a medical emergency, contact local emergency services immediately.
7. Services for businesses and professionals
Design, development, backend and operations services for businesses and professionals are provided under a separate written agreement that states scope, timeline, price and ownership. Where that agreement and these Terms conflict, the written agreement applies to those services.
8. Acceptable use
You agree not to:
- share, sell or transfer your access to anyone else;
- copy, scrape, reverse engineer or redistribute any part of the Services;
- interfere with the operation or security of the Services;
- use the Services for any unlawful purpose or in violation of these Terms;
- impersonate another person or misrepresent your identity.
9. Intellectual property
The Services, including software, text, graphics, audio and design, are owned by SCJ Hogar LLC or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Services for your own non-commercial use during your access period.
10. Your content
Information you enter into an app remains yours. You grant us a license to store and process it only as needed to provide the Services to you, as described in our Privacy Policy.
11. Changes to the Services
We may update, add or retire features over time. If we discontinue an app during a period you have paid for, we will refund the unused portion of that period on a pro rata basis.
12. Suspension and termination
We may suspend or end your access if you breach these Terms. You may stop using the Services at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability and governing law) will survive.
13. Disclaimers
The Services are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Services will be uninterrupted or error-free, or that using them will produce any particular health result.
14. Limitation of liability
To the fullest extent permitted by law, SCJ Hogar LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow these limitations, so they may not apply to you.
15. Governing law and disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. If you have a dispute with us, contact us first and we will try to resolve it informally. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction. If you are a consumer in a country whose laws give you mandatory protections, nothing in these Terms takes those protections away.
16. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here with a new "Last updated" date. If a change is material, we will make reasonable efforts to notify you. Continued use of the Services after a change means you accept the updated Terms.
